Digital Product Terms

These terms apply to presets, LUTs and other downloadable files purchased from Marc Bächtold, Sandweg 2, 75217 Birkenfeld, Germany, info@marcbaechtold.com.

1. Product information and contract

The product page describes the included files, supported software and price. A binding contract is concluded when the checkout confirms the order. The order confirmation and these terms are provided electronically. Prices and any applicable taxes are shown before the order is submitted.

2. Delivery

Digital products are delivered by a protected download link after successful payment. The purchaser is responsible for providing a valid email address and retaining a secure local backup. If a valid download fails, contact support so that access can be restored.

3. Licence

Unless a product page states otherwise, the purchaser receives a non-exclusive, non-transferable licence to install and use the files in their own photography and film workflow. Resulting images and films may be used for personal or commercial projects. The preset, LUT or source files themselves may not be shared, resold, sublicensed, published as a download, included in another product or otherwise redistributed.

4. Compatibility

Compatibility is limited to the software and versions described on the product page. Results vary with source material, camera profiles, exposure, colour management and individual adjustments. Product files do not guarantee a particular creative or commercial result.

5. Right of withdrawal for digital content

For paid digital content that is not supplied on a physical medium, the statutory right of withdrawal can expire when delivery begins before the end of the withdrawal period, provided that the purchaser expressly requests immediate performance, acknowledges the resulting loss of the right of withdrawal and receives the legally required confirmation. The checkout asks for this express request and acknowledgement before the order is submitted. Statutory rights concerning defective digital products remain unaffected.

6. Support, defects and refunds

Support covers access to the purchased files and reasonable help with the documented installation process. If files are defective or do not match the agreed description, statutory remedies apply. Nothing in these terms excludes mandatory consumer rights or liability that cannot lawfully be limited.

7. Updates

A purchase includes the version delivered at the time of sale. Future feature updates, new formats or compatibility with later third-party software are included only when expressly stated.

8. Governing law and dispute resolution

German law applies without depriving consumers of mandatory protection under the law of their habitual residence. We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
